Digital Millennium Copyright Act Policy
Welcome to (the ‘Site’). We uphold the intellectual property rights of others just as we expect others to respect our rights. According to the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their agent can submit a takedown notice to us through our DMCA Agent listed below. As an internet service provider, we can claim immunity from infringement claims under the “safe harbor” provisions of the DMCA. To submit an infringement claim to us, you must provide the following information:
Notice of Infringement – Claim
- A physical or electronic signature of the copyright owner (or someone authorized to act on behalf of the owner);
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the infringing material to be removed, and information to help locate the material;
- Contact information of the complaining party including name, address, email, phone number, and fax number;
- A statement that the use of the material is unauthorized by the copyright agent;
- A statement that the information provided is accurate and the complaining party is authorized to act on behalf of the copyright owner.
Title 17 USC §512(f) imposes civil damage penalties against anyone who knowingly misrepresents information in a notification of infringement under 17 USC §512(c)(3).
All takedown notices should be sent through our Contact page, preferably by email for prompt attention.
When submitting a claim, you acknowledge that we may share your identity and information with the alleged infringer.
Counter Notification – Restoration of Material
If you receive a takedown notice due to a copyright infringement claim, you can provide us with a counter notification to have the material restored. The notification must be in writing and contain the following elements per 17 USC Section 512(g)(3):
- Your physical or electronic signature.
- A description of the material taken down and its original location.
- A statement under penalty of perjury that the material was removed due to mistake or misidentification.
- Your name, address, and telephone number, consenting to jurisdiction for legal matters.
Send your counter notice through our Contact page, preferably via email.
Repeat Infringer Policy
We adhere strictly to copyright infringement policies. Under the DMCA, we keep a list of notices and make efforts to identify repeat infringers, who may have their accounts terminated.
